I was just given my 2 weeks notice, as my job has become "redundent". Which is total BS!!! I am second in seniority with six below me. Including four that have been hired in the past 3 months. One only 3 weeks ago! They still have a help wanted sign on their property. Actually the bosses son has started working again within the past two weeks.(He left last year to try and start his own business, I assuming it didn't work out).

I recently filed a claim with employment standards because they were not paying on time. So I wouldn't be at all surprised if this had something to do with it.

I asked why my job is redundent, I was told there was not enough work. Really? Then why is there that big order of steel that just came in?!! Then why are you getting rid of me before everyone else? Just doesn't add up

I will be filing a claim for wrongful dismissal. I will try to get letters from those that have been hired recently. I will aslo try to get witnesses who can verify the help wanted sign that has been on the lawn(I get along quite well with some of the guys that work in the shop next to us).

Hopefully I'll be back on my feet before the fall.

Sorry to hear about your bad luck!!

If the "help wanted" sign is still on the lawn go and take a picture of it with the company in the background.

My prediction is that this is a good thing for you. Dont be bitter and start looking for something better. Two years from now I want you to look back and see if I was right. Been there, done that! Good Luck to you!

Rejection always tics us off. But in truth if these guys are such A holes why did you want to stay and put up with the BS. There are really good companies and employers out there. Take a breather and then decide you are NOT going to jump on the first pony that comes along. Decide the situation you want and trust you have the expertise to get it.

The biggest problem with being unemployed, is that almost anywhere you look for work..............

It can be tough to face the unexpected end of your employment, but once you look at the other opportunities it may open up you may not feel so disappointed. I worked for a company for almost 16 years, pi**ed the boss's wife off by refusing to run errands for her on my personal time, and was dismissed the next morning. I was devistated by the dismissal, but drew unemployment for a while then a friend offered me a job helping him with his electric & plumbing business (I had been an electricial in the navy). He loved the electric work, and I soon fell in love with the plumbing. I finally started my own plumbing contractor business and he was happy to send me work. Been self-employed as a plumbing contractor for nearly 20 years now, and the thing that annoys me most about getting fired is that they didn't do it 15 years sooner! :wink:
Now, my step-son got fired from his job yesterday. He's been there 3 years and one of his bosses (a drug user who was probably messed up) started an argument with him and finally attacked him physically! The company fired them both. I told him to sign up for unemployment, the start job hunting, but be selective! In the mean time he can help me on a few jobs to keep him occupied. :lol:

Sorry to hear about your situation. I own my own bussiness so i do no a little what the Employment Standard Act. Was your place of work unionized? If not seniortiy means nothing an employer can terminate anyone regardless of how long they have worked with company with no reason at all. However the employer must pay termination pay up to or equal to 8 weeks pay. So basically what that means is 1 weeks pay for each year worked up to maximum of 8 weeks. The employee is only eligibale for terimantion and serverance pay if the employee is unionized or if the company's payroll exceeds 2.5 million dollars per year.

So in the end if they have done what i have explained then i'm sorry but you really can't do anything :x If they have not followed protocol contact the Ministry of Labour. Hope this helps you~!

It is crap like what happened to you that makes me glad to spend that 15 bucks a week on union dues . Take a breather then go on the hunt for something better . Shouldn't take you long , times seem pretty good right now . Good luck .

Sorry to hear about this. I have to agree with some of the post here though, it'll most likely be a good thing come next year. From what you told me about these guys, it was obvious that it was not a long term career for you. Give me a call if I can help in any way. If you give me some ideas of what you'd like to tackle next, I'll keep my eyes and ears open.

Chris..contact the Ontario Labour Relations Board Employment Standards Branch...they will tell you whether or not you have a claim as well as how many weeks notice is required...depending on how long you have been employed there you may have a good claim.....if you' only been there 5-10 years, then most likey you will only be entilted to 1 weeks severqacne pasy for each year of service...as I do not know you, are you white, are the fellas been kept on white....if not, racial discrimination may alos be involved..also, notify the individula you have been dealing with at Employment Standards redgarding not been paid on time & i'm sure he/she can steer you in the right direction....quite frankly, do you really want to stay working there?????????

I phoned the Employment Standards Officer who was dealing with my original claim this morning. I asked if there been any contact with my employer with this, she said she contacted them on Wednesday.

I mentioned that I was being fired and had asked my boss if this had anything to do with my claim, he said he had no idea what I was talking about. I now know that he was lying.

The officer said that was a reprisal(an act of retaliation), and there would be an officer paying them a visit within two days!! It is against the law for an employer to discipline any employee for filing a claim. I think they are in for a costly lesson!!

I'm sure future employment will be very unpleasant , if at all possible, but at the same time I refuse to be intimidated or abused by anyone. So I will be seeking employment elsewhere, but will follow through with my claims.

I took a gamble when I ended my previous career. I found new life with this job. It is unfortunate that it has come to this because the work that we were producing is really second to none. Check out www.wroughtironart.net and you will see what I mean. That is the reason I hung in there for so long. I knew I couldn't learn this anywhere else. I'm hopeful that I will soon start my own business, the equipment is piling up. It's just a matter of time.
